MHP Terms of Use

Version 1.3. Effective November 4, 2026.

These terms are an agreement between you and Maximizing Human Potential, Inc. ("MHP," "we," "us") about your use of mhpdevelopment.com and the MHP Player Development Portal (the "service"). By using the service you agree to them. Our Privacy Policy explains what information the service collects and how it is handled; it is part of these terms.

1. Who may use the service

Programs (schools, teams and clubs) use the service under an agreement with MHP. Athletes use it through their program. An athlete under 18 may use it only after a parent or legal guardian and the athlete have signed the program's Family Permission Form. Coaches and staff use it after signing the Staff Confidentiality Agreement. Individual coaches and practitioners, and their adult clients, use it by invitation from MHP. You may not use the service if you are under 13 unless your program and your parent or guardian have set up your account as described above.

2. Your account

Keep your username and password private and do not share your account. Tell your program or us right away if you think someone else has used it. Your program decides who on its roster and staff has an account and can turn accounts on and off. Typing your name where the service asks for a signature is your electronic signature and carries the same weight as signing on paper.

3. What the service is, and what it is not

The service is a coaching and record-keeping tool. Coaches use it to track, coach and support athletes against the standards their program sets. It is not medical care, counseling, nutrition therapy or an emergency service. Calorie targets and meal plans are general guidance for a healthy athlete, not medical advice; if you have a medical condition, a history of an eating disorder, or a doctor's diet, follow your doctor. Readiness scores, device data and check-ins are information for coaching, not a diagnosis. If you are hurt, see an athletic trainer or a doctor. If you are in crisis, call or text 988 or go to the nearest emergency room. A red Heart Check gets a coach's attention that day, but it is not a substitute for getting help.

4. How you agree to use it

Be honest in what you enter. Keep what you learn about teammates to yourself. Use the service only for your program's coaching purposes. Do not try to see another person's record, another program's data, or any part of the service you were not given access to. Do not share login links or team codes outside your program. Do not copy the service by automated means, interfere with it, or try to get around its security. A program that uploads a roster or records confirms it has the right to share that information with us for coaching.

5. Your information and ours

Your information belongs to you and your program. You give MHP permission to host, process and display it to provide the service, as the Privacy Policy describes, and for nothing else. The service itself, including its software, designs, standards framework, text and videos, belongs to MHP, and you may not copy, sell or build a competing product from it. You may print or save your own record at any time.

6. Connected devices

If you connect a wearable or scale, you authorize MHP to read the data you choose to share, through the device maker's official connection, until you disconnect. The device maker's own terms apply to your device and account. You can disconnect at any time in the portal or in the device maker's app.

7. Confidentiality for coaches and staff

A coach or staff member's use of the service is also governed by the Staff Confidentiality Agreement signed at first sign-in, which limits use of athlete information to this program and these athletes.

8. Changes and availability

We work to keep the service running and improving, and we may add, change or remove features. We will give programs notice of changes that matter. The service is provided as it is and as it is available; we do not promise it will always be free of errors or interruptions, and we make no warranties beyond those the law requires.

9. Responsibility

To the extent the law allows, MHP is not responsible for indirect or consequential losses arising from use of the service, and our total responsibility to you for any claim is limited to the amount your program paid MHP for the service in the twelve months before the claim, or one hundred dollars if nothing was paid. Nothing in these terms limits responsibility that the law does not allow to be limited, including for harm caused by our own gross negligence or willful misconduct.

10. Ending use

A program may stop using the service at any time, and may ask us to delete its records as the Privacy Policy describes. We may suspend or end an account that breaks these terms, after notice where practical. Sections 5, 9 and 11 continue after use ends.

11. Law and disputes

These terms are governed by the laws of the State of Louisiana. If we have a dispute, we will each try in good faith to resolve it by talking first. Any claim that cannot be resolved that way will be brought in the state or federal courts for East Baton Rouge Parish, Louisiana.

12. Changes to these terms

When these terms change, we will post the new version here with a new date and tell programs in the portal. Continuing to use the service after a change means you accept it.
